The following general conditions constitute an integral part of your booking made with Select Sicily (“we”, “us” “our”) In these booking conditions, “you” and “your” means all persons named on the booking.
2.STIPULATION/AGREEMENT AND CONCLUSION OF CONTRACT AND TERMS OF PAYMENT.
You can initiate a booking by telephoning us direct or via e-mail. Upon confirmation of your booking we must receive a 30% deposit of the total cost of your booking within 3 days and the balance not less than 8 weeks before departure. You may pay using PayPal, any major credit card and bank transfer. Please note a 2% credit charge will be levied on all credit card and PayPal payments. A binding contract between you and us comes into existence as soon as any payment is received. Failure to pay within 3 days means the booking will be cancelled. In the event the booking is made within 56 days of the departure date, payment is required in full.
3. PRICES AND SERVICES.
The prices published are weekly and refer to the period indicated in the price column. The minimum stay in the high season is 14 days (except other options to verify upon booking) with arrival and departure from Saturday to Saturday.
Energy bills are included in the price unless otherwise stated. The price list also tells you if final cleaning is included. Eventual additional services like daily and weekly cleaning, extra linen changes etc. can be requested and paid for locally.
All information on our site regarding the description of local amenities and infrastructure (means of transport, shops, and sports facilities etc.) is supplied by third parties who may not have told us of any recent changes. Moreover, problems can occur in the correct supply of gas, water, and electricity. In this event, and for adverse weather conditions, we cannot be held responsible.
4. CHANGES IN PRICE AND SERVICES.
The description and price of the property has been carefully prepared, however, they may undergo changes and these will be communicated at the time of initial enquiry or booking.
5. DEPARTURES, ARRIVALS AND SHORT STAYS OR EXTENSIONS OF STAY.
Arrival time is between 3 and 7pm and the departure time is before 10am. If you cannot arrive within these hours you must contact the key holder at the number written on your travel document who, at their discretion, will fix a new appointment.
In the event you are unable to reach your property on day one due to strikes, travel or personal problems, a refund is not possible. The same rule stands for early departure. In order to extend your stay, you must contact us in useful time.
6. CANCELLATION OF CONTRACT BY YOU.
It is possible to cancel your confirmed booking 56 days prior to departure or more and it must be notified by special delivery or e-mail during our business hours (i.e. not on Sunday or when our office is closed) and a cancellation charge of 30% of the total invoice is applicable; from 56 to 43 days before departure a cancellation charge of 60% of the total invoice is applicable; from 42 days to 28 days before departure the charge is 80%; if the cancellation is made 27 days before departure the invoice must be paid in full.
7. CHANGES AND CANCELLATION OF THE CONTRACT BY US.
We reserve the right, in exceptional circumstances, to replace the booked property with an alternative property of a similar standard. If we are unable to do so you are entitled to a refund of all monies paid. Very rarely, after departure but before the scheduled end of your stay “force majeure” may prevent us from fulfilling our contractual obligations, we regret we cannot accept liability or pay any compensation where the performance of our obligations is prevented or affected by events (whether actual or threatened) such as war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, volcanic eruptions, flood, wild fires, epidemic, closure, restriction or congestion of airports or airspace and all similar events or circumstances outside our control or the control of the supplier concerned.
Upon arrival and at the delivery of the keys you must pay a damages deposit cash to the owner/manager of the property, he/she reserves the right not to deliver the keys if you fail to do so. Upon departure the deposit will be refunded if no damage has occurred otherwise a reasonable assessment of damage costs will be taken from the deposit. The owner will also have the right to refuse any guest exceeding the total number of the party in the booking.
9. OUR LIABILITY.
We promise to use reasonable skill and care in making your booking and selecting the property, property owners and any other suppliers we work with. We have no responsibility for the properties themselves or for any services provided by or on behalf of property owners or other suppliers or for the acts or omissions of any property owner or other supplier or any of their employees, agents, suppliers, or subcontractors. Please note it is your responsibility to show that reasonable skill and care has not been used by us in our selection of the relevant property, property owner or other suppliers if you wish to make a claim.
10. COMPETENT COURT.
Any legal controversy will be dealt with under Italian law in the jurisdiction of Marsala where we are legally constituted.
